Welcome to morrowmio! The terms “we”, “us” and “our” refer to morrowmio. morrowmio operates this online store, including all related information, content, features, tools, products and services (the “Services”). morrowmio is powered by Shopify.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use our Services.
These Terms of Service apply to all users of the site. For customers located in the European Union and Germany, mandatory statutory rights — including consumer protection laws — apply in addition to and, where applicable, override these Terms.

Section 1 – Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence. You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer or assign your account to any other person.

Section 2 – Our Products
We have made every effort to accurately represent our products and services. However, colors or product appearance may differ depending on your device settings. We do not warrant that the appearance or quality of any products will meet your expectations.
All product descriptions are subject to change at any time at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person or region.

Section 3 – Orders and Contract Formation
When you place an order, you are making a binding offer to purchase. The purchase contract between you and morrowmio is concluded when we send you an order confirmation by email. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting, as morrowmio may be unable to accommodate cancellation requests after a contract is concluded. In the event that we do not accept or cancel an order, we will notify you by email.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy and the statutory right of withdrawal described below.

Section 4 – Prices, Taxes and Billing
All prices displayed in our store are inclusive of applicable VAT (Mehrwertsteuer) in accordance with German law. Shipping costs are shown separately and will be clearly stated before you complete your order.
Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.
You agree to provide current, complete and accurate payment and account information. You warrant that you are authorized to use the payment method provided.

Section 5 – Shipping and Delivery
Delivery times stated on our website are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control.
Once products are transferred to the carrier, risk of loss passes to you. If you are a consumer in Germany or the EU, risk of loss does not pass until the goods are delivered to you or a person designated by you.

Section 6 – Right of Withdrawal
If you are a consumer resident in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the standard outbound delivery costs (the delivery costs we charged you when sending the goods to you), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.
We offer only one standard delivery option. Accordingly, the full outbound delivery costs paid by you will be included in your refund.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Return shipping costs: You will bear the direct cost of returning the goods. We do not provide prepaid return labels. Please use a trackable shipping method, as we cannot be held responsible for items lost in return transit.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Section 7 – Statutory Warranty
As a consumer in Germany or the European Union, you are entitled to statutory warranty rights under applicable law. In Germany, the statutory warranty period is two (2) years from delivery of the goods.
If goods are defective at the time of delivery, you are entitled to request repair or replacement. If repair or replacement is not possible or fails, you may request a reduction in price or withdraw from the contract.
These statutory rights are not limited or affected by our Return Policy or any other contractual provisions.

Section 8 – Intellectual Property
All content on our Services is owned by morrowmio or its licensors and is protected by applicable intellectual property laws. You may use our Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works without our prior written consent.

Section 9 – Optional Third-Party Tools
We may provide access to third-party tools over which we have no control. Such tools are provided “as is” without any warranties. Your use of optional third-party tools is entirely at your own risk.

Section 10 – Third-Party Links
Our Services may contain links to third-party websites. We are not responsible for the content or accuracy of any third-party websites. Complaints regarding third-party products should be directed to the third party.

Section 11 – Relationship with Shopify
morrowmio is powered by Shopify. Any sales and purchases you make are made directly with morrowmio. Shopify is not responsible for any aspect of sales between you and morrowmio.

Section 12 – Privacy Policy
All personal information we collect is subject to our Privacy Policy, available on our website. We comply with the requirements of the General Data Protection Regulation (GDPR) and applicable German data protection law.

Section 13 – Errors, Inaccuracies and Omissions
We reserve the right to correct any errors and to change or update information at any time without prior notice. This does not affect any rights you have already acquired under a concluded contract.

Section 14 – Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services for any unlawful or malicious purpose, to violate any applicable laws, to infringe intellectual property rights, to transmit malicious code, or to collect personal information of others without consent.

Section 15 – Limitation of Liability
To the extent permitted by applicable law, morrowmio shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.
Nothing in these Terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded under applicable German or EU law, including mandatory consumer protection rights.

Section 16 – Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Germany. For consumers resident in the European Union, the mandatory consumer protection laws of your country of residence also apply and take precedence where they provide greater protection.
The EU Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

Section 17 – Changes to Terms of Service
We reserve the right to update or change these Terms of Service at any time. We will notify you of any material changes in accordance with applicable law. Your continued use of the Services following any changes constitutes acceptance of the new terms.
